RV Stewards' Report - Ethan Brown, Jamie Kah, Ben Melham and Celine Gaudray

Racing Victoria (RV) Stewards have today issued one charge each against licensed jockeys Ethan Brown, Jamie Kah and Ben Melham and apprentice jockey Celine Gaudray for allegedly providing false and/or misleading evidence to them.

The Stewards have charged each of the four jockeys with breaching AR232(i) which reads as follows:

AR 232 Failure to observe processes and directions of PRAs or Stewards

A person must not:

(i) give any evidence at an interview, investigation, inquiry, hearing and/or appeal which is false or misleading.

The particulars of the charge are summarised as follows:

  • On 25 August 2021, Ethan Brown, Jamie Kah, Ben Melham and Celine Gaudray were each present at an “Airbnb” in Mornington after 9pm in breach of the current State Government Regulations (namely the Stay-at-Home Directions) and RV’s COVID Protocols.
  • On 26 August 2021, Ethan Brown, Jamie Kah, Ben Melham and Celine Gaudray were each interviewed by RV Stewards with respect to their attendance and the attendance of others at the Mornington gathering.
  • The evidence tendered by Ethan Brown, Jamie Kah, Ben Melham and Celine Gaudray to RV Stewards during their interview is alleged to be false and/or misleading given each, when asked to communicate the list of attendees at the Mornington gathering, failed to state that licensed jockey Mark Zahra was also in attendance.

Pursuant to the Racing Act 1958, given AR 232(i) is defined as a serious offence under the Rules of Racing, the charges issued today against Ethan Brown, Jamie Kah, Ben Melham and Celine Gaudray must be heard and determined by the Victorian Racing Tribunal (VRT). This will occur on a date to be fixed. 

On 27 August 2021, Ethan Brown, Jamie Kah, Ben Melham and Celine Gaudray each had their licence to ride in races suspended for a period of three months for breaching AR 232(b). Please click here to read that related Stewards Report. 

RV Stewards' Report - Mark Zahra

Racing Victoria (RV) Stewards have today issued one charge against licensed jockey Mark Zahra for allegedly providing false and/or misleading evidence to them.

Mark Zahra has been charged with breaching AR232(i) which reads as follows:

AR 232 Failure to observe processes and directions of PRAs or Stewards

A person must not:

(i) give any evidence at an interview, investigation, inquiry, hearing and/or appeal which is false or misleading.

The particulars of the charge are summarised as follows:

  • On 25 August 2021, Mark Zahra was present at an “Airbnb” in Mornington after 9pm in breach of the current State Government Regulations (namely the Stay-at-Home Directions) and RV’s COVID Protocols.
  • On the morning of 28 August 2021, Mark Zahra was interviewed by RV Stewards with respect to his alleged attendance at the Mornington gathering and denied being present, before contacting RV Stewards at 5.30pm that afternoon to report that he was in attendance.
  • The evidence tendered by Mark Zahra to RV Stewards during the interview on the morning of 28 August 2021 is alleged to be false and/or misleading.

Pursuant to the Racing Act 1958, given AR 232(i) is defined as a serious offence under the Rules of Racing, the charge against Mark Zahra must be heard and determined by the Victorian Racing Tribunal (VRT). This will occur on a date to be fixed.
