Notice to Trainers - Carbine Chemicals Products

On 13 August 2020, Racing Victoria sent a Notice to Trainers (RV Notice) which noted that the Australian Pesticide and Veterinary Medicines Authority (APVMA) had issued a recall notice to Carbine Chemicals Pty Ltd (the Company) on 30 July 2020 in relation to specific unregistered products (the APVMA Recall Notice). 

The APVMA Recall Notice required the Company to immediately stop supply of the listed products; to immediately notify any person who has possession or custody of the listed products either directly or indirectly because of a supply by the Company that they must stop supply of the products and return it to the Company immediately; and take all necessary steps to recover all stocks of the listed products from any person that the Company has either directly or indirectly supplied the products to.

On 9 September 2020, the Company notified Racing Victoria that it is appealing the decision by the APVMA to issue the APVMA Recall Notice, and that the Australian Administrative Tribunal has stayed the operation of the APVMA Recall notice.  This means that the APVMA Recall Notice currently has no legal effect.  

Accordingly, Trainers are no longer advised to immediately stop use of any of the products listed in the RV Notice and to return them to the Company.  Regardless, Racing Victoria again takes the opportunity to remind trainers of the relevant Rules of Racing in relation to unregistered substances, namely AR 252. 

We will send a further Notice to Trainers once we are made aware of any progress with respect to this matter.
