Acceptance fee for the Caulfield Guineas and the Thousand Guineas
shall be refunded.

3 The Committee reserves the right to make from time to time any alteration or modification
to the conditions governing this race and also to alter the date and time for receiving entries,
payments and declarations and date of races.
4 To determine age eligibility for the Caulfield Guineas and the
Thousand Guineas the following rule applies:
”AR.46. The age of a horse shall be reckoned as follows:
a) If it was foaled between the first day of July and the thirty-first day of December –
i ) from the first day of August in the year in which it was foaled if its dam was
first covered on or after the first day of September in the previous year, as that
covering is recorded by the Stud Book.
ii) from the first day of August in the year previous to the year in which it was
foaled if its dam was first covered before the first day of September in the
year previous to the year in which it was foaled, as that covering is recorded
in the Stud Book.
b) If it was foaled between the first day of January and the thirtieth day of June, from
the first day of August in the year previous to the year in which it was foaled.”

For the purpose of elimination:

Each horse handicapped above the advertised minimum weight (for its age group) shall be appended
with a weight below, equal to, or above the benchmark weight for that horse, as the case may be.

Each horse handicapped on the minimum weight (for its age group) shall be appended with a weight
figure that is not more than 9.0kg below the benchmark weight for that horse, and is not less than or
equal to the appended weight figure for a horse of the same age and gender handicapped above the
advertised minimum weight (for its age group).

Such appended weight figure below, equal to, or above a horse’s benchmark weight shall not affect
the weight to be carried in the race by any horse.

MAXIMUM WEIGHT

There is no maximum weight for this race.

MINIMUM TOP WEIGHT

AR 103 (1) provides that the top weight in any Group 1 handicap in Australia must not be less than 58kg when weights are released.

AR 103 (2) exemption provides that there is no minimum top weight required at the declaration of acceptances.

WEIGHT ALLOWANCES

No allowances for apprentices.

GUIDELINES

These guidelines are intended to make it absolutely clear that horses do not qualify to gain entry to the field for the 2018 Stella Artois Caulfield Cup, rather they provide for horses to be eliminated there
from.

Only performances in flat races of 1600 metres or further shall be taken into account in satisfying the elimination clauses for the 2018 Stella Artois Caulfield Cup.

EXEMPT RACES

The winners of the 2018 VRC Makybe Diva (Craiglee) Stakes, MVRC Dato’Tan Chin Nam (Feehan)
Stakes, Melbourne Racing Club Underwood Stakes, Naturalism Stakes, VRC Turnbull Stakes,
Melbourne Racing Club Herbert Power Stakes, Caulfield Stakes, Mornington Cup, Nikkei Shin Hun Hai (JPN), Kyoto Kinen (JPN), Nikkei Sho (JPN), Sheema Classic (UAE), Osaka Hai (JPN), QEII Cup (HK),  Jockey Club Stakes (UK), Champions and Chater Cup (HK), Meguro Kinen (JPN), Grand Prix de Chantilly (FR), Hardwicke Stakes (UK), Takarazuka Kinen (JPN), Princess of Wales’s Stakes (UK), Glorious Stakes (UK), Ballyroan Stakes (IRE), Sapporo Kinen (JPN), Grosser Preis Von Berlin (GER) and Great Voltigeur Stakes (UK) shall not be eliminated from the 2018 Stella Artois Caulfield Cup, provided that in the case of a dead-heat for first, the Committee may exercise its absolute discretion as to which horse or horses involved in the dead-heat shall be exempt from elimination.

The above applies to horses that are nominated and are then first, second and final acceptors in the 2018 Stella Artois Caulfield Cup.

PENALTIES

The winner, after declaration of weights, of:

any handicap flat race run over a distance of 1600 metres or further of the advertised value of $60,000 or over to the winner (2018 Herbert Power Stakes excepted), or

any internationally recognised Listed handicap, Group handicap or Graded handicap race run over a distance of 1600 metres or further (2018 Herbert Power Stakes excepted) is to carry such additional weight (if any) for each win as the Handicapper shall determine.

Provided that, in lieu of re-handicapping, should such winner be a horse on the minimum handicap
weight (for its age group) the Handicapper may, at his discretion, instead amend the originally
appended weight figure against the benchmark weight downwards, to a figure that is not less than
or equal to the appended weight figure for a horse of the same age and gender handicapped above
the advertised minimum weight (for its age group).

Any such amendments referred to above shall not affect the weight to be carried in the race.
In these circumstances, any extra weight to be imposed on any horse, or in lieu of re-handicapping,
any amendment to the appended weight figure against the benchmark weight for a horse shall be
declared by the Handicapper not later than five (5) working days after such win.

CLAUSE ONE

Horses which have not on or after 1 August, 2017 up to the time of final acceptances:

a) won or been placed second or third in an Internationally recognised Group 1 or Grade 1 or
Group 2 or Grade 2 race or Group 3 or Grade 3 race on the flat of 1600 metres or further, or

b) won an Internationally recognised Listed race on the flat of 1600 metres or further, or

c) won the Ebor Handicap (UK)

Shall be eliminated in order of the lowest appended weight figure against the benchmark weight for each individual horse.
For the purposes of sub-paragraph (a) above, wins, second, third, fourth and fifth placings in any internationally recognised Group, Graded or Listed race shall be taken into account, provided that $60,000 (AUD) or more was received for any such win or placing.
Provided however, that prizemoney acquired as follows will not be taken into account when
assessing prizemoney for any of these elimination clauses:

d) Prizemoney acquired by a horse(s) in any race restricted to horses sold at a particular sale or
bred, trained or sold in a particular region or state, and

e) Bonuses and/or incentives received by a horse in respect of any race.

Further, provided that past winners of the Caulfield Cup, W.S. Cox Plate and Melbourne Cup will not
be eliminated under this clause.

CLAUSE TWO


Should the number of horses exceed the number of horses required to be eliminated from the race after the operation of Clause One (or any part thereof), then such elimination shall be effected by order of the lowest appended weight figure against the benchmark weight for each individual horse within this clause.

In the event that two or more horses whose appended weight figure below the benchmark weight are the same, such elimination shall be effected by order of the lowest peak international rating of the preceding 12-month period.

The rules of racing of Racing Victoria apply to this race.

CONDITIONS OF ENTRY


1. All owners, including those involved in syndicates, trainers and all licensed persons shall abide by and accept any and all decisions of the Committee taken in respect of the elimination conditions for the 2018 Stella Artois Caulfield Cup; such decisions are final and conclusive for all purposes and shall not be capable of challenge in any legal proceedings.

2. In the event of a horse being eliminated from the field only the final declaration fee will be refunded, unless the Committee otherwise determines.

3. The Committee reserves to itself the absolute right to make, from time to time, any alteration, variation or modification to the elimination clauses, terms and conditions of and governing the 2018 Stella Artois Caulfield Cup including the right to alter the date and/or time for receiving entries, payments and the making of declarations.

4. The Committee reserves to itself the right to reject at any time, or otherwise to seek further information in respect of any entry submitted for the 2018 Stella Artois Caulfield Cup.

5. The Committee reserves to itself the prerogative to declare a field, or field size, which may be less than the prescribed safety limit but which, in the opinion of the Committee, is in keeping with the reputation and International status of the race.

6. All currency amounts stated are in Australian dollars ($AUD) and the exchange rate for the purpose of the elimination clauses and conditions of entry are to be applied as at the first working day in January in the calendar year in which such prizemoney was earned.

7. Reference to the race being “Internationally recognised” means a race published by the International Cataloguing Standards Committee in part 1 of the International Cataloguing Standards as receiving Black Type (Group, Graded or Listed status) for the year such race was run.

8. All entry and acceptance fees quoted are in Australian Dollars ($AUD) and inclusive of Goods & Services Tax (“GST”). All prizemoney amounts quoted are in $AUD and exclusive of GST and any required GST amount will be added by the Club to any sum of money payable to an entity registered for GST as identified by its Australian Government approved Australian Business Number (“ABN”).

9. All dates and times quoted are in Australian Eastern Standard Time (AEST) / local Melbourne time.

EMERGENCY ACCEPTORS

Provision may be made for the naming of up to 4 horses as emergency acceptors to replace horses scratched or withdrawn after final acceptances but only up to 7:30am on the day on which the 2018 Stella Artois Caulfield Cup is conducted.

The winner of the 2017 Japan Cup (26 November 2017) shall not be eliminated from the 2018 Ladbrokes Cox Plate.

Please note that the 2018 Ladbrokes Cox Plate winner is eligible for a bonus (in addition to prizemoney) if it finishes in the first three of the 2018 Japan Cup:

RACE CONDITIONS

“The field” (maximum 14 with provision for 4 emergencies) will be determined by the MVRC Committee at final acceptance time with consideration being given to:

- International Ratings (International Federation of Horse Racing Authorities) and
- ANZ Classifications, plus Interim Ratings (produced by Racing Victoria Chief Handicapper Greg Carpenter)

COMMITTEE DISCRETION

The Committee of the Moonee Valley Racing Club may in its absolute and unfettered discretion:

(a) Exclude any horse or horses from the 2018 Ladbrokes Cox Plate (subject to exempt races) irrespective of whether or not the field limit of 14 horses and 4 emergencies (“the field”) as at final acceptance time shall be reached;

(b) Exempt any horse or horses;

(c) Select the field to compete in the 2018 Ladbrokes Cox Plate with the assistance of an advisory panel including Racing Victoria Racing Operations & Chief Handicapper and in so doing have regard to but not be bound by the race conditions set out above.

GENERAL CONDITIONS:

1. GOODS AND SERVICES TAX (GST) - GST will be added by the Club to any sum of money payable to an entity quoting an ABN (Australian Business Number). A further explanation can be obtained by contacting the MVRC Finance Controller, phone: +61 3 9373 2306. All Nomination and Acceptance Fees quoted are inclusive of GST.

2. PRIZEMONEY DISTRIBUTION - With regard to horses earning prizemoney for being placed 1st to 10th inclusive, respective prizemoney payable shall be distributed as follows: Owner - 85%; Trainer - 10%; Jockey - 5%.

3. In the event of a horse being eliminated at final acceptance, only the final acceptance fee ($54,450) shall be refunded. If a Final Late Nomination Fee ($200,000) has also been paid it shall be refunded.

4. Nominations for the above race shall only be received on condition that the Rules of Racing and Regulations of Racing Victoria now or hereafter in force shall be binding in all respects.

5. The Committee reserves the right to make from time to time any alteration or modification to the conditions governing the race, and also to alter the date and time for receiving nominations, payments and acceptances.

6. AR.112. (f) For the purpose of calculating the value of prizemoney earned in other countries by a horse which is entered for an Australian race, the rate of exchange shall be used which was current on the first working day of January of the year in which such prizemoney was earned, as determined by a Trading Bank nominated by the Australian Racing Board.

7. An international horse is a horse that resides outside of Australia and New Zealand and is sent to Melbourne, trained by an overseas trainer (NZ exempt) to compete in the race.

For the purpose of any ballot on this race:
Each horse handicapped above the advertised minimum weight (for its age group) shall be appended with a weight figure that is below, equal to, or above the benchmark weight for that horse, as the case may be.
Each horse handicapped on the minimum weight (for its age group) shall be appended with a weight figure that is not more than 9.5kg below the benchmark weight for that horse, and is not less than or equal to the appended weight figure for a horse of the same age and gender handicapped above the advertised minimum weight (for its age group).
Such appended weight figure below, equal to, or above a horse’s benchmark weight shall not affect the weight to be carried in the race by any horse.

MAXIMUM WEIGHT

There is no maximum weight for this race.

MINIMUM TOP WEIGHT

AR 103 (1) provides that the top weight in any Group 1 handicap in Australia must not be less than 58kg when weights are released.

AR 103 (2) exemption provides that there is no minimum top weight required at the declaration of acceptances.

WEIGHT ALLOWANCES 

No allowances for Apprentices.

DECLARATIONS OF ACCEPTANCE

First and Second Declarations must be forwarded by the nominator or agent to Racing Australia Trainers Service Centre.

Final Declarations lodged on AAMI Victoria Derby Day may be effected in person by the nominator or agent at Flemington Racecourse, or through Racing Australia Trainers Service Centre.

Overseas Clubs and Agents authorised to receive entries are also authorised to receive Declarations of First and Second Acceptance.

Declarations of Final Acceptance cannot be lodged outside Australia.

Any horse for which any declaration has not been received at closing time will be automatically withdrawn.

CONDITIONS OF FINAL ACCEPTANCE
 (1) If Racing Victoria (RV) Stewards receive and accept an RV veterinary surgeon’s report that a particular horse would have been unfit to compete in the Lexus Melbourne Cup race if it was held on the actual day of final acceptance closing, then such horse shall not be a final acceptor for this race. 

Provided that, in the instance of a horse that competes in a race at Flemington on 2018 AAMI Victoria Derby Day –

exclusion from final acceptance for this race will apply only if RV Stewards accept an RV veterinary surgeon’s report that such horse cannot reasonably be expected to be fit to compete in the Lexus Melbourne Cup three days hence.

(2) A final acceptor included in the established field of (up to) 24 horses may not be subsequently withdrawn from this race by its nominator or agent.  

The application of Australian Rule 8 (u) (power of Stewards to withdraw a horse if in their opinion it is unfit to run) will apply if the circumstances warrant it. 

RIDER NOTIFICATION 
 By 7.00 PM (Melbourne Time) SATURDAY 3 NOVEMBER

PENALTIES

The winner, after declaration of weights, of an internationally recognised Listed, Group or Graded flat race

- If a handicap race, only if it was run over a distance of 1600 metres or further, OR
- If a non-handicap race, only if it was run over a distance of 2300 metres or further

is to carry such additional weight (if any) for each win as the Handicapper shall determine. Any determination by the Handicapper in respect to additional weight (if any) to be carried, shall not be made prior to the running of the race in which the winner became liable for a penalty.
Provided that, in lieu of re-handicapping, should such winner be a horse on the minimum handicap weight (for its age group) the Handicapper may, at his discretion, instead amend the originally appended weight figure against the benchmark weight downwards, to a figure that is not less than or equal to the appended weight figure for a horse of the same age and gender handicapped above the advertised minimum weight (for its age group).
Any such amendments referred to above shall not affect the weight to be carried in the race.  
In these circumstances, any extra weight to be imposed on any horse, or in lieu of re-handicapping, any amendment to the appended weight figure against the benchmark weight for a horse, shall be declared by the Handicapper not later than five (5) working days after such win.
BALLOTING CONDITIONS
 (1)  The Directors may in their absolute discretion exclude any horse or horses from the race, whether the safety limit of 24 horses at final acceptance time shall be reached or not, and if such exclusion occurs, and more than 24 final acceptors remain, balloting of surplus horses will continue in the normal manner to its conclusion.

The winner of the following, if any should be a nomination and a first, second and final acceptor for the 2018 Lexus Melbourne Cup, shall be exempt from any ballot on this race:

- 2018 VRC Bart Cummings
- 2018 VRC Hotham Handicap
- 2018 MVRC Cox Plate
- 2018 MRC Caulfield Cup 

(2)  Subject always to the Directors' absolute discretion, as stated, remaining final acceptors in excess of the safety limit of 24 horses shall be eliminated in the following order, until the safety limit is reached:

Horses OTHER THAN those that have registered a “Relevant Race Performance”, as set out below:

Relevant Race Performances
A) since 1 February 2017 inclusive, won or was placed 2nd or 3rd in an internationally recognised Group or Graded flat race run over 2300 metres or further; OR won or was placed 2nd or 3rd  in the Queensland Derby, Queensland Oaks or Brisbane Cup OR

B) since 1 February 2017 inclusive, was placed 4th or 5th in an internationally recognised Group 1 or Grade 1 flat race run over 2300 metres or further in which horses older than 3 years old could run, OR

C) since 1 February 2017 inclusive, won an internationally recognised Listed flat race run over 2300 metres or further, OR

D) since 1 February 2017 inclusive, won or was placed 2nd or 3rd in the York Ebor (UK) or Champions & Chater Cup (HK), OR

E) since 1 February 2017 inclusive, won the Northumberland Plate (UK), Cesarewitch (UK), or Queen Mother Memorial Cup (HK), OR

F) was placed 6th, 7th or 8th in the 2018 MRC Caulfield Cup, OR

G) was placed 2nd or 3rd in the 2018 MVRC Cox Plate, OR

H) won the 2018 VRC Seppelt Turnbull Stakes, OR

I) won or was placed 2nd or 3rd in the 2016 Melbourne Cup, OR

J) won the 2016 Caulfield Cup
Should the number of such horses exceed the number of horses required to be eliminated from the race, then such elimination shall be effected by order of the lowest appended weight figure against the benchmark weight for individual horses, as the case may be.
Horses in this clause (2) with the same lowest appended weight figure against the benchmark weight for individual horses, as the case may be, shall be eliminated at the discretion of the Directors.

(3)  If, after Balloting Clause (2) has been exhausted, excess horses remain, then subject to the exercise of the Directors’ discretion, elimination of such horses shall be effected by order of the lowest appended weight figure against the benchmark weight for individual horses, as the case may be.

Horses in this clause (3) with the same lowest appended weight figure against the benchmark weight for individual horses, as the case may be, shall be eliminated in order of lowest aggregate prizemoney received in “Relevant Race Performances” since 1 February 2016 inclusive.  Horses equal in both of these respects shall be eliminated at the discretion of the Directors.

 SPECIAL NOTES

1. The Japan Racing Association (JRA) will officially invite the 2018 Lexus Melbourne Cup winner to the 2018 Japan Cup, with JRA covering expenses for the invited horse, including round-trip air transportation and other ancillary expenses. A $USD2m bonus will be paid by the JRA should the 2018 Lexus Melbourne Cup winner also win the 2018 Japan Cup. The JRA will also officially invite the 2018 Lexus Melbourne Cup winner to compete in the 2019 Tenno Sho (Spring).
2. A horse that is a final acceptor for this race, and is subsequently balloted from it, is eligible to earn a $100,000 bonus should it win the 2018 VRC Queen Elizabeth Stakes over 2600m at Flemington on Saturday 10 November. (Please refer to Queen Elizabeth Stakes race conditions).

GENERAL CONDITIONS

1. Entries for the 2018 Lexus Melbourne Cup will only be received upon the express basis that all of the terms and conditions applying to the race (including these General Conditions) shall be legally binding in all respects and shall govern all entries for the race.
2. In the event of a horse being eliminated under the balloting conditions, only the Final Acceptance fee ($49,500) shall be refunded.
3. The Board reserves the right to make from time to time any alteration or modification to the conditions governing this race, and also to alter the date and time for receiving entries, payments and declarations.
4. The Board reserves the right to reject at any time any entry submitted to it.
5. All currency amounts stated are Australian dollars; ($AUD).
6. Reference to a race being "internationally recognised" means a race published by the IRPAC in Part 1 of the International Cataloguing Standards as receiving black-type (Group, Graded or Listed status) for the year such race was run.
7. Breeders' bonuses and/or other bonuses will not be taken into account when calculating prizemoney won for determining of penalties and/or balloting order.
8. Performances by horses in match races or private sweepstakes are not recognised under the conditions of this race.  The definition of a “match race” or “private sweepstakes”, in any particular instance, is at the absolute discretion of the Directors.
9. In assessing a horse’s performance in a race, for the purposes of these conditions a “dead heat” for a win or placing is deemed to be a win or the specific placing outright.
10. All entry and acceptance fees quoted are inclusive of Goods & Services Tax, (GST).  All prizemoney and Starters' Rebates amounts quoted are exclusive of GST, and any required GST amount will be added by the Club to any sum of money payable to an entity registered for GST, as identified by its Australian Government approved Australian Business Number.

FLEMINGTON RACECOURSE

Australia’s International Racecourse, Flemington, is situated six kilometres west from the Melbourne CBD, by the Maribyrnong River.  On raceday the course is accessible by car, tram, special race trains or rivercraft.

Flemington has been the venue for the running of the Melbourne Cup since it was first run in 1861.  With a capacity for up to 120,000 people, it is famous world-wide for its four-day Melbourne Cup Carnival.  In 2018, this magnificent week of racing will comprise: AAMI Victoria Derby Day on Saturday 3 November; Lexus Melbourne Cup Day on Tuesday 6 November; Kennedy Oaks Day on Thursday 8 November, and Stakes Day on Saturday 10 November.

SCRATCHINGS
 Betting on the 2018 Lexus Melbourne Cup will start in earnest soon after entries are closed.  To reduce the possibility of the public placing non-refundable wagers on horses that will not be starting, nominators are urged to officially withdraw a horse immediately after a decision is made not to run.

PRIZEMONEY DISTRIBUTION

For horses earning prizemoney for being placed 1st – 10th inclusive, respective prizemonies payable shall be distributed as follows:

Owner - 85%; Trainer - 10%; Rider - 5%

CURRENCY EXCHANGE RATES

AR 112 (f) For the purpose of calculating the value of prizemoney earned in other countries by a horse which is entered for an Australian race, the rate of exchange shall be used which was current on the first working day of January of the year in which such prizemoney was earned, as determined by a Trading Bank nominated by the Australian Racing Board.

AR 60 - “The nominator of a horse which has been registered as a racehorse outside Australia must provide in writing by entry closing time to the Principal Club in the area in which the horse is entered to race:

(a) in the case of a horse which has never started in a race, a statement to that effect.
(b) in the case of a horse which has had its last start in a race in an overseas country, a statement advising:
(i) the total number of starts,
(ii) the racecourse and date of each start
(iii) the type of race and the distance
(iv) the finishing position and the weight carried
(v)  the total of the prizemoney offered for each race and the amount received for winning or being placed in any such race.

Details of performances in overseas countries must be certified by an official of the controlling body of racing in the territory overseas in which such horse last raced.”
