3. Entry is free and, subject to paragraph 4 of these Terms and Conditions, automatic for all licensed Victorian jockeys (including apprentices) aged 18 years and over.
4. A jockey is ineligible to win a Prize in this Competition if that jockey:

(d) has otherwise, in the opinion of Racing Victoria, conducted themselves in a manner which has undermined the integrity, reputation or public image of racing during the Promotional Period.
Prize Conditions
5. Before issuing a Prize, Racing Victoria reserves the right to request proof of eligibility, including that:
(a) the Winner is licensed as a jockey in Victoria in accordance with the Rules of Racing; and
(b) the Winner is not ineligible to enter the Competition, including that the Winner is not ineligible by virtue of paragraph 3 above or paragraph 20 below.
General
6. Subject to paragraph 7 and paragraph 8, all Eligible Entrants will be automatically entered into the Competition which will allocate one (1) point per start and the following additional points:
(a) the first placed jockey shall receive three (3) additional points;
(b) the second placed jockey shall receive two (2) additional points; and
(c) the third placed jockey shall receive one (1) additional point,
for each Victorian thoroughbred race conducted by Racing Victoria during the Promotional Period.
7. In the event of a dead heat, both jockeys will be awarded the relevant additional points. By way of example:
(a) in a first placed dead heat, both jockeys will be awarded three (3) additional points each;
(b) in a second placed dead heat, both jockeys will be awarded two (2) additional points each; and

(c) the third placed jockey shall receive two (2) additional points,
for each Country Cup race conducted by Racing Victoria during the Promotional Period.
9. If any thoroughbred race horse does not satisfactorily pass any sampling or inquiry procedure or any other reasonable condition of Racing Victoria relating to the race or Competition (including any condition pursuant to the Rules of Racing) during the Promotional Period, all points that would have been awarded in that relevant calendar month to a rider of the relevant race horse during the Promotional Period, pursuant to paragraphs 6 to 8 above, will be cancelled.
10. The winner is the Eligible Entrant with the most points (as calculated pursuant to paragraphs 6 to 9 above) at 11:59pm on the last day of the end of the relevant calendar month during the Promotional Period (Winner). In the event of a tie, the Eligible Entrant who has ridden the most winners (or if this is not determinative, attained the most second places and so on) across the relevant calendar month will be awarded the Prize. For the avoidance of doubt, if any thoroughbred race horse does not satisfactorily pass for any reason listed in paragraph 9 above, or a jockey is subsequently found to be ineligible for any reason listed in paragraph 4 above, after a Winner has already been declared (i.e. after the relevant calendar month), there shall be no retrospective adjustment to the relevant calendar month’s points and the Winner will stand.

14. In accordance with the requirements of the Gambling Regulation Act 2003 (Vic) and Gambling Regulations 2015, each entrant agrees that Racing Victoria may publish, or cause to be published, the names of the Winners on Racing Victoria’s website (for a minimum of twenty-eight (28) days) and/or Racing Victoria’s social media platforms and online or print publications.
15. Prizes will be paid by Racing Victoria and will be processed in accordance with Racing Victoria’s payment terms and conditions (and within thirty (30) days after a Winner is declared). Prizes will be paid to the Winner’s bank account provided to Racing Victoria for the purposes of the payment of prizemoney and it is the entrant’s responsibility to ensure that Racing Victoria has up-to-date bank account details. For the avoidance of doubt, a Prize does not constitute prizemoney for the purposes of the Rules of Racing.
16. The Prize is not transferable or assignable to another person and Racing Victoria accepts no liability and provides no guidance or assurance on any potential tax implications of receiving the Prize.
17. If a Prize is paid to an entrant in error (Relevant Prize), the entrant will be notified in writing as soon as reasonably practicable (Notice). If an entrant disputes that the Relevant Prize was paid in error, the entrant must respond to Racing Victoria within seven (7) days of receipt of the Notice with reasons as to why the entrant disputes the matter (Response). Racing Victoria will consider the Response in good faith and liaise with the entrant should Racing Victoria require any further information.
18. Notwithstanding paragraph 17 above, entrants acknowledge that Racing Victoria may set off any obligation owed by Racing Victoria to the entrant pursuant to the Rules of Racing against the amount of any Relevant Prize due to Racing Victoria from the entrant pursuant to these Terms and Conditions.

An entrant may not transfer, copy, reproduce, distribute, exploit or use any of the Materials.
23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

(d) any loss or damage (including loss of opportunity and loss of profits) whether direct, indirect, special or consequential, arising in any way out of any act or omission, including deliberate or negligent, by Racing Victoria or its servants or agents, in connection with this Competition or the arrangement for supply of any goods or services by any person to the entrants;
(e) personal injury, except where arising from wilful misconduct or a negligent act of Racing Victoria or its servants or agents.
25. If, for any reason, this Competition is not capable of running as planned because of any cause beyond the control of Racing Victoria, which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Racing Victoria reserves the right in its sole discretion to cancel, terminate, modify or suspend this Competition.
26. Without limiting paragraph 4, Racing Victoria reserves the right in its sole and absolute discretion to disqualify from this Competition any individual whom Racing Victoria has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this Competition.
27. This Competition shall be governed by and construed with reference to the laws in force in the State of Victoria and entrants submit unconditionally to the jurisdiction of the appropriate courts of the State of Victoria.
